5 Year Old Girl Falls from 5th Floor Window

A 5-year-old girl fell out of a fifth floor apartment building window at approximately 5:30 pm in Springfield, MA. As a result of the fall, the girl suffered several broken bones. A resident reported the fall to building security, who then informed authorities. She was taken to Bay State Medical Center for treatment. Her current condition has not yet been released.

As the warm weather arrives and windows are opened more often, the potential for children to fall increases significantly. Swartz & Swartz, P.C. has extensive experience handling many forms of premises liability claims. For example, we recently achieved a 1 million dollar recovery for an 18-month-old girl and her mother. In that case, the toddler suffered a significant closed head injury after a fall from a second floor apartment in which the window screen had become dislodged. Landlords and owners are often responsible for safely maintaining screens, as well as ensuring that apartments comply with all applicable building codes.
